Terms and Conditions

Preston Campbell Foundation Lottery draws are conducted by, and in aid of the charitable services of the Preston Campbell Foundation Limited, (ABN 89609934296) (Beneficiary) and NORTEC, trading as PCF Alliance, (ABN 88129092280) (Beneficiary) operations throughout Australia.

RESULTS

The 1st Prize winner will be contacted by their supplied phone number (s) and email. All Prize winners are notified in writing within 7 days from the draw via email or mail. Results are published online on the Winners page at www.pcflottery.org.au on the day of the draw.

GENERAL LOTTERY CONDITIONS

  • Tickets AUD $5 each.
  • To enter, eligible entrants must purchase one or more lottery tickets from the website or through such direct marketing channels as may be utilised by the Beneficiary or the Lottery Manager from time to time.
  • Credit card payments must be received by close date to be entered into the draw.
  • Only payments for tickets in the current lottery will be accepted. Pay-In-Advance orders are not accepted.
  • Lottery tickets are not tax deductible.
  • All lottery prizes are not taxable under the prescribed lottery arrangements.
  • PCF Lottery accepts no liability for any tax implications that may arise from winning a prize.
  • If, for any reason, in the reasonable opinion of the Beneficiary the Lottery is unable to be undertaken as intended, the Beneficiary reserves the right, in its sole discretion, to cancel, modify, or suspend the Lottery subject to relevant regulatory authority requirements.

CONDITIONS OF ENTRY

  • Entrants must be 18 years or older at the time of purchase of a ticket in the lottery.
  • If requested, entrants must be able to produce proof of age and residency, prior to being awarded a prize.
  • Entries not completed in accordance with these terms and conditions are ineligible.
  • The Beneficiary reserves the right, in its sole discretion, to disqualify individuals who it has reason to believe have breached any of these terms and conditions, engaged in unlawful conduct, or engaged in practices to jeopardise the fair and proper conduct of the lottery.

The following persons are ineligible for entry:

  • People engaged in the management, sales, or supervision of the lottery and their immediate family, as well as the Lottery Managers, employees, directors, managers and immediate family, are all ineligible to enter the Lottery.
  • Immediate family members for a person identified above, means including the person’s spouses; de facto spouses; parents; siblings, half-siblings; and children residing at the same premises as the person.
  • It is the sole responsibility of all entrants of the Lottery to ensure they are eligible and abide by their country’s laws/regulations prior to making a ticket purchase and accept the prize/s offered as a part of the Draw. Entrants agree to the publication of their ticket number, suburb, state and postcode in the event of a winning ticket.

EARLY BIRD BONUS DRAW

  • Early Bird Bonus Draw – 2 x $500 Gift Card Prize. To enter, purchase tickets in a PCF Lottery before the date indicated. Tickets purchased through an Aspire Club membership will automatically be entered into the Early Bird Bonus Draw and will be eligible to win as per the Aspire Club Draw eligibility. Early Bird bonus draw is drawn following the Major Draw Prizes. Refer to lottery prize details for dates and further terms and conditions.

ASPIRE CLUB DRAWS

By signing up as a PCF Aspire Club Supporter, tickets purchased through your membership are automatically entered into PCF Lottery exclusive Aspire Club Supporter draws, in addition to the Major Prize Draw.

Early Bird Draw**: 2 x $500 Gift Card

To be eligible for the Aspire Club Supporter Prize Draws you must be a PCF Lottery Aspire Club Supporter at the date of entry into the relevant Aspire Club Supporter draw with a successful ticket purchase in PCF Lottery 1, one (1) entry per ticket purchased in PCF Lottery 1 with an Aspire Club membership attached. A PCF Lottery Aspire Club Supporter is defined as a supporter that has an ongoing automatic subscription order of one (1) or more tickets purchased via Credit Card or PayPal. All Aspire Club ticket purchases are eligible for the Aspire Club Prize Draws. All draws are conducted at L11, 135 Coronation Drive, Milton QLD 4064, following the Major Prize Draw. Winners are advised via their nominated phone and/or email address after the draw.

** Tickets purchased through an existing Aspire Club membership will be automatically entered into the Early Bird draw and be eligible to win as per the Aspire Club membership eligibility.

PRIZES GENERAL

  • All Prize suppliers nominated by PCF Lottery.
  • All Prizes are valued at manufacturers/suppliers recommended retail (list price (RRP or MSRP), price including GST.
  • All Prizes are payable in Australian dollars and delivered within mainland Australia. Winners are responsible for ensuring they make arrangements in accordance within these conditions.
  • Prizes are not transferable or redeemable for cash.
  • Photographs and props are for illustration purposes only and do not necessarily depict exact Prize detail.
  • Where Prizes are Cash* or Gift Card, Victorian residents receive a Woolworths Essential Gift Card (supplied electronically and not redeemable for cash) for Prizes under $5,000, and Gold Bullion for Prizes worth $5,000 and over.
  • Where Prizes are described as Gift Cards it will be delivered as an electronic gift card to the email address on record or it may be delivered vis SMS to the mobile phone number on record. If an email or mobile phone number is not on record and/or cannot be obtained a Woolworths Essential gift card will be issued.
  • Winning ticket numbers and winners are validated against records held in our database and all draws are final.
  • The Beneficiary will use its reasonable endeavours to provide the winner with the Prize for which they are eligible and elect for as listed above. The Beneficiary reserves the right, in its absolute discretion, to substitute the Prize with that of an equivalent value.
  • A winner is only eligible to receive the Prize or part thereof that is listed as applicable to that winner’s State or Territory of residence.
  • Where a Prize winner in unable to be contacted, or any prize remains unclaimed, the requirements of the Beneficiary reserves the right to sell the prize in accordance with the relevant regulatory authority requirements at time of permit approval as follows:
  • Queensland: Until the prize is given to the winner, the prize will be kept for one year from the day the prize winner is decided. If the Prize is not claimed within one year, the Beneficiary may apply the prize or its sale proceeds to the Beneficiary’s purpose. However, this does not affect a person’s right to claim a prize during the period for claiming a prize, which is 3 years from the day the prize winner is decided.
  • Victoria: If a winner does not claim a prize in a raffle and the person who conducted the raffle cannot, after reasonable efforts to do so, find a winner of the prize the community or charitable organisation to benefit from the raffle must ensure that the prize is retained for 12 months after the draw or, if the prize is livestock or property of a perishable nature, may sell the prize in a way that brings a reasonable price and retain the proceeds (after deducting the reasonable costs of the sale) for 12 months after the draw. If a prize or proceeds of the sale of a prize retained under sub-regulation remain unclaimed after a period of 12 months after the draw of the raffle, the community or charitable organisation must sell or otherwise dispose of the prize if this has not already been done and must pay the proceeds (after deducting the reasonable costs of the sale or disposal) to the Treasurer for payment into the Consolidated Fund.
  • For all other locations, including Queensland, the Queensland requirements will be followed.

ADDITIONAL TERMS

  • The winner must provide all information and sign all documentation necessary to enable the Beneficiary and/or the Lottery Manager to award the winner the Prize.
  • In the event payment for your purchase of a ticket is received after the draw has closed tickets will automatically be allocated to the next available draw.
  • If you do not want to be entered in the next draw, please contact us within 7 days of your order being processed, so we can issue a refund. We can be contacted by emailing: support@pcflottery.org.au
  • The Beneficiary reserves the right, in its sole discretion, to recover damages, or other compensation it may deem sufficient, in the event an individual breaches these terms and conditions.
  • The Winner agrees to participate in promotional activities associated with winning, including, but not limited to, being interviewed, and photographed. The Winner grants to the Beneficiary and the Lottery Manager, exclusive rights to use such audio, footage, and/or photographs. The Winner is not entitled to a fee or other payment for the use of these promotional activities.
  • There is an agreement with TMS Global Services Pty Ltd (ACN 089 771 835), to promote, sell tickets or conduct this raffle for reward.

REFUND POLICY

PCF Lottery is committed to ensuring customer satisfaction with all tickets purchased in our Lotteries. Tickets in the current Lottery may be returned and cancelled before the close of the Lottery for a full refund of the ticket price. All tickets not returned by the closing date will be valid for the Draw and therefore able to win a prize so cannot be refunded. PCF Lottery may at its discretion and on a case-by-case basis, refund after the lottery has been drawn.

PRIVACY

Details of how the Beneficiary uses, collects, stores, and manages personal information can be found in our Privacy Policy which is linked here www.pcflottery.org.au/about/privacy. If you have any questions or concerns regarding our Privacy Policy, please contact us on support@pcflottery.org.au The Beneficiary, the Lottery Manager and its authorised marketing partners reserve the right to send marketing communications to any entrant that opts-in to receive communications from the Lottery Manager and its authorised marketing partners. By making a purchase, you are opting in to receiving marketing communication. The entrant can advise the Beneficiary at any time if they no longer wish to receive this information, by contacting the Beneficiary’s Privacy Officer atsupport@pcflottery.org.au. The Beneficiary, the Lottery Manager and its authorised marketing partners may continue to send communications to those who have purchased a ticket in the lottery for an indefinite period unless, and until, advised otherwise by the entrant.

Jurisdiction
These terms and conditions are governed by and to be interpreted in accordance with the laws in force in Australia including but not limited to the State of Queensland, New South Wales and Victoria. In the event of any dispute arising in relation to these terms and conditions or any dispute arising in relation to the website or application, whether in contract or tort or otherwise, the Courts of Queensland, New South Wales and Victoria and any Courts competent to hear appeals therefrom will have non-exclusive jurisdiction over such dispute.

Severance
